hereinafter referred to as the provider, the contract is concluded.

Object of agreement

This contract regulates the sale of new and used goods from the electronics & computers sector(s) via the provider’s online shop. For the details of the respective offer, reference is made to the product description on the offer page.

Contract

The contract is concluded exclusively in electronic business transactions via the shop system. The offers presented represent a non-binding invitation to submit an offer by the customer order, which the provider can then accept. The ordering process for concluding a contract in the shop system includes the following steps:

  • Selection of the offer in the desired specification (size, color, number)
  • Add the offer to the cart
  • Pressing the ‘order’ button
  • Entering the billing and delivery address
  • Selection of payment method
  • Review and processing of the order and all entries
  • Pressing the ‘order for a fee’ button
  • Confirmation email that order has been received

The contract is concluded with the sending of the order confirmation.

Period of contract

The contract has a term of 0, subject to termination.

Ownership

Until full payment has been made, the delivered goods remain the property of the provider.

Provisos

The Provider reserves the right not to provide the promised service in the event of unavailability.

Prices, shipping costs, return costs

All prices are final prices and include VAT. Unless otherwise noted, the services offered are privately purchased second-hand goods. According to § 25a UStG, these are taxed on the margin, so that VAT is not shown on the invoice. In addition to the final prices, there are other costs depending on the shipping method, which will be displayed before the order is shipped. If there is a right of withdrawal and this is exercised, the customer bears the costs of the return.

Terms of payment

The customer has only the following options for payment: advance transfer, direct debit, payment service provider (PayPal), credit card. Other payment methods are not offered and will be rejected.

The invoice amount must be transferred in advance to the account specified there after receipt of the invoice, which contains all the information for the transfer and is sent by e-mail. The invoice amount will be collected by the Provider by direct debit on the basis of the direct debit authorization by the Customer from the customer’s specified account. When using an escrow service/payment service provider, it allows the provider and customer to process the payment among themselves. In this case, the escrow service/payment service provider forwards the customer’s payment to the provider. Further information can be found on the website of the respective escrow service/payment service provider. When paying by credit card, the customer must be the cardholder. The credit card will be charged after the goods have been shipped. The Client is obliged to deposit or transfer the stated amount to the account specified on the invoice within 30 days of receipt of the invoice. Payment is due without deduction from the date of invoice. The customer is only in default after a reminder.

Terms of delivery

The goods will be shipped immediately after receipt of the order. Shipping takes place after 3 days at the latest on average. The entrepreneur undertakes to deliver on the 12th day after receipt of the order. The standard delivery time is 4 days, unless otherwise stated in the item description. The provider either ships the order from its own warehouse as soon as the entire order is in stock there or the order is shipped by the manufacturer as soon as the entire order is in stock there. The customer will be informed immediately of any delays. If the Provider is not responsible for a permanent impediment to delivery, in particular force majeure or non-delivery by its own supplier, although a corresponding hedging transaction has been concluded in good time, the Provider has the right to withdraw from a contract with the customer in this respect. The customer will be informed immediately and any services received, in particular payments, will be refunded.

Warranty

Consumers are entitled to a statutory right to liability for defects for the services offered in accordance with the relevant provisions of the German Civil Code (BGB). If this is deviated from, the warranty is based on the provisions written for this purpose in the General Terms and Conditions (GTC). If the customer is a consumer, the warranty period for used goods is limited to one year. This does not apply to claims for damages by the customer due to injury to life, limb, health or essential contractual obligations, which must necessarily be fulfilled in order to achieve the contractual goal. This also does not apply to claims for damages following a grossly negligent or intentional breach of duty by the provider or its legal representative or vicarious agent. In all other respects, the statutory regulations apply.

Contract

The customer has no way of accessing the stored contract text directly. The customer can correct errors in the entry during the ordering process. To do this, he can proceed as follows: Via the customer shop account or by email.

Withdrawal

You have the right to withdraw from this contract within fourteen days without giving reasons.

The withdrawal period is fourteen days from the day on which

  • In the case of a contract of sale: in which you or a third party designated by you, who is not the carrier, has taken possession of the last goods.
  • In the case of a contract for several goods ordered by the consumer as part of a single order and delivered separately: on which you or a third party designated by you who is not the carrier has taken possession of the last goods.
  • In the case of a contract for the delivery of goods in several instalments or pieces: in which you or a third party designated by you, who is not the carrier, has taken possession of the last partial shipment or piece.
  • In the case of a contract for the regular delivery of goods over a fixed period of time: on which you or a third party designated by you who is not the carrier has taken possession of the first goods. In the case of several alternatives, the most recent point in time is decisive.

In order to exercise your right of withdrawal, you must inform us (Connstore GmbH, Managing Director: Damian Pomorski, Rheinpromenade 13, 40789 Monheim, TEL: 0176/66216853, info@connstore.de) of your decision to withdraw from this contract by means of an unequivocal statement (e.g. a letter sent by post, fax, or e-mail). You can use the attached model withdrawal form for this, but it is not mandatory.

In order to comply with the withdrawal period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.

Consequences of revocation

If you withdraw from this contract, we shall reimburse you all payments we have received from you, including delivery costs (with the exception of the additional costs resulting from the fact that you have chosen a type of delivery other than the low-cost standard delivery offered by us), without undue delay and at the latest within fourteen days from the day on which we received the notification of your withdrawal from this contract. For this refund, we will use the same means of payment that you used for the original transaction, unless otherwise expressly agreed with you; in no case will you be charged any fees for this repayment. We may withhold reimbursement until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.

You must return or hand over the goods without undue delay and in any case no later than fourteen days from the day on which you inform us of the revocation of this contract to Connstore GmbH, Managing Director: Damian Pomorski, Rheinpromenade 13, 40789 Monheim, TEL: 0176/66216853, info@connstore.de. The deadline is met if you send the goods before the expiry of the fourteen day period.

You will bear the direct costs of returning the goods.

They only have to pay for any loss in value of the goods if this loss of value is due to handling of them that is not necessary to check the nature, characteristics and functioning of the goods.

End of the cancellation policy

Disclaimer

Claims for damages by the customer are excluded, unless otherwise stated for the following reasons. This also applies to the representative and vicarious agent of the Provider if the Customer asserts claims for damages against them. Excluded are claims for damages by the customer due to injury to life, limb, health or essential contractual obligations, which must necessarily be fulfilled in order to achieve the contractual goal. This also does not apply to claims for damages following a grossly negligent or intentional breach of duty by the provider or its legal representative or vicarious agent.

Prohibition of assignment and pledging

Claims or rights of the Customer against the Provider may not be assigned or pledged without the Provider’s consent, unless the Customer has proven a legitimate interest in the assignment or pledge.

Language, Jurisdiction and Applicable Law

The contract is drafted in German. The further implementation of the contractual relationship will be in German. The law of the Federal Republic of Germany shall apply exclusively. For consumers, this only applies to the extent that it does not restrict any legal provisions of the country in which the customer has his domicile or habitual residence.

Privacy

In connection with the initiation, conclusion, processing and rescission of a purchase contract on the basis of these GTC, data is collected, stored and processed by the provider. This is done within the framework of the legal provisions. The Provider does not pass on any personal data of the Customer to third parties unless it would be legally obliged to do so or the Customer has expressly consented in advance. If a third party is used for services in connection with the handling of processing processes, the provisions of the Federal Data Protection Act are complied with. The data provided by the customer by way of the order will be processed exclusively for the purpose of contacting you within the scope of the contract processing and only for the purpose for which the customer has provided the data. The data will only be passed on to the shipping company that takes over the delivery of the goods in accordance with the order to the extent necessary. The payment data will be passed on to the bank commissioned with the payment. If the provider is subject to retention periods of a commercial or tax nature, the storage of some data can take up to ten years. During the visit to the provider’s Internet shop, anonymised data that does not and does not intend to draw any conclusions about personal data, in particular IP address, date, time, browser type, operating system and pages visited, is logged. At the request of the customer, the personal data will be deleted, corrected or blocked within the framework of the legal provisions. Information about all personal data of the customer is possible free of charge. Severability clause

The invalidity of any provision of these GTC shall have no effect on the validity of the other provisions.

Alternative dispute resolution according to Art. 14 para. 1 ODR-VO and § 36 VSBG:

The European Commission provides a platform for online dispute resolution (ODR), which you can find under https://ec.europa.eu/consumers/odr . We are not obliged and are not willing to participate in dispute resolution proceedings before a consumer arbitration board.
